You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
3. Services Provided
We offer shared hosting, WordPress hosting, VPS, dedicated servers, and domain name registration services as a reseller.
All domain name registrations are subject to the relevant registry terms and ICANN policies, and may also be governed by the terms of our upstream registrar partner.
4. Service Availability
We strive to maintain high uptime and reliable service, but we do not guarantee uninterrupted operation. Scheduled maintenance, system upgrades, or third-party network issues may occasionally cause downtime.
5. Acceptable Use
You agree not to use our Services for:

Illegal or infringing activity;

Spamming, phishing, or distributing malware;

Hosting adult, defamatory, or copyrighted material without proper rights;

Attempting to disrupt or damage Novara systems or other users’ services.
Violations may result in immediate suspension or termination without refund.
6. Payment & Billing

All prices are shown in GBP (£) and include VAT where applicable.

Payment is due in advance for all Services.

Unless cancelled, Services automatically renew at the end of each billing period.

You authorise us to charge your chosen payment method for recurring fees.

Non-payment may result in suspension or termination of your Services.
7. 30-Day Money-Back Guarantee
We offer a 30-day money-back guarantee on our standard hosting plans (shared, WordPress, VPS, and dedicated servers).
Refund requests must be submitted within 30 days of the initial order.
This guarantee does not cover:

Domain name registrations, renewals, or transfers;

SSL certificates or other third-party add-ons;

Licensing fees (e.g., cPanel, Plesk, CloudLinux);
-
Any services suspended or terminated due to breach of these Terms.
Refunds are processed back to the original payment method within 7–10 working days.
8. Data & Content Responsibility
You retain ownership of your website files, databases, and content.
You are responsible for ensuring your data complies with UK law, including copyright and privacy obligations.
Novara does not monitor or verify content but reserves the right to remove illegal material upon complaint or notice.
9. Backups
Backups may be provided as part of your plan; however, we do not guarantee availability or integrity of backups.
You are solely responsible for maintaining independent copies of your data.
10. Limitation of Liability
To the extent permitted by law:

Novara shall not be liable for any indirect, consequential, or economic loss;

Our total liability shall not exceed the total fees paid in the preceding 12 months;

We are not responsible for downtime, domain issues, or losses caused by third parties or user error.
Nothing in these Terms limits liability for death, personal injury, or fraud.
11. Indemnification
You agree to indemnify and hold harmless Novara, its employees, and partners from any claims or damages arising from your use of our Services or breach of these Terms.
12. Data Protection & GDPR Compliance
Novara complies with the UK GDPR and Data Protection Act 2018.
We process personal data only as necessary to provide and manage your Services.

13. Suspension & Termination
We may suspend or terminate your Services if:

You breach these Terms or our Acceptable Use Policy;

Payment is overdue;

Your activity endangers our network or reputation.

14. Consumer Rights (UK Customers)
If you are a UK consumer, you have certain rights under the Consumer Contracts Regulations 2013.
You may cancel your contract for most digital services within 14 days of purchase, unless the service has already been activated at your request.
This right does not apply to domain registrations or completed hosting activations.

16. Governing Law & Jurisdiction
These Terms are governed by English law.
Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
